This Privacy Policy describes how GoKidu ("we", "us", or "our") collects, uses, and shares information when you use our mobile application or Website or application for sperm, egg, or embryo donation and surrogacy services.

1. Where This Privacy Policy Applies

This Privacy Policy applies to the website, mobile application (“App”) and any other services we operate under GoKidu, Inc. We just refer to all of these as our “Services” or individually as a “Service” in this Privacy Policy.

If for some reason, one of our Services requires its own separate privacy policy, then that policy will be made available to you and that policy -- not this Privacy Policy -- will apply in the use of that Service.

2. Data We Collect

GoKidu collects information from its users/Members in the following categories:

Active:This is data that you directly provide to GoKidu by completing query forms and uploading to any of our Services.

  • Account Data: When you register on our site/App or complete your profile, you may be asked to submit some personal information.
    • Basic Profile through forms you may be asked to enter your full name, e-mail address, and other personal details like birthdate, address.
    • Advanced Profile: Hobbies, Values, Interests, government-issued ID, photos, education details, occupation, blood group/type, medical reports (STD/STI, semen, genetic), physical details (height, hair color, eye color), ethnicity, nationality, religious beliefs/affiliations, etc.
  • Content: You may post photos, text, and other types of content, such as your chats with other members.
  • Purchase Data: When you make a purchase, we keep the details of the transaction including, but not limited to, purchased item or Service, the date of the transaction, and the price. The exact data depends on the payment method you choose. When you pay directly with us, you provide your debit or credit card number or other financial info to a third-party vendor known as Stripe. We do not keep your financial information stored on our servers, rather it is instantly transmitted to Stripe to process any payments for Services.
  • Marketing, Survey and Research Data: We sometimes run (i) surveys, focus groups, or market studies for research purposes and (ii) promotions, events or contests for marketing purposes. When you choose to participate, you give us information to process your entry and participation, as well as your responses to our questions and your feedback.
  • Third-Party Data: Information that you share about other people such as using the contact details of someone you know for a feature of our Services or if you submit a query or report involving a Member, we process this data on your behalf to complete your request.
  • Customer Support Data: When you make a request from GoKidu, you provide us with information that may be necessary to help address your inquiry. Other people may also submit queries or reports involving you. Finally, our moderation tools and teams can collect additional data as part of their investigations
  • Services Data: Geolocation data.
  • Other Applications Data: You may decide to share data with us through your accounts on other platforms such as iOS/Apple or Google/Android. For instance, if you decide to create and log into your account via these platforms or if you decide to upload data such as photos onto our service from these platforms.

Passive Data: This is information that we collect from you that is obtained with your consent through the acceptance of our Terms of Use and is automatically acquired from you just by accessing and/or utilizing our Services.

  • Consumer Report/Safety Data: Where and when legally allowed, we can also receive or obtain information about suspected or convicted persons from third parties as part of our efforts to ensure our Members’ safety and security.
  • Technical Data: IP Address: We store the IP address from which you log into our site. Google, as a third-party vendor, uses cookies to serve ads on our site. Google's DART cookie serves ads based on your visit to our sites and other sites on the Internet. You can opt-out of the DART cookie by visiting the Google ad and content network privacy policy.

3. How and Why We Use and Share Your Information

We use your data to provide our Services to you and improve those Services over time. We also process your data for Members safety and security while using our Services. And, we process your data to show relevant ads – you can control this in your settings.

The personal information we collect is used for the following purposes:

  • Matching Donors with Recipients: To accurately match donors with recipients based on compatibility and specific requirements.
  • Communication: To facilitate effective communication between donors, recipients, and our Services, including updates, Service information, and administrative messages.
  • Record Maintenance: To maintain comprehensive and accurate records of donors and recipients for operational integrity and efficient service delivery.
  • To Personalizing User Experience: Your information helps us to respond better to your individual needs.
  • To Improving Our Website/Mobile App: We continually strive to improve our website and App offerings based on the information and feedback we receive from you.
  • To Improving Customer Service: Your information helps us respond more effectively to your customer service requests and support needs.
  • To Processing Transactions: Other than for the express purpose of delivering the requested product or service, your information, whether public or private, will not be sold, exchanged, transferred, or given to any other company for any reason without your consent.
  • To Administering Activities: Such as contests, promotions, surveys, or other site features.
  • To Sending Periodic Emails: The email address you provide may be used to send you information and updates pertaining to your order, in addition to receiving occasional company news, updates, related product or service information, etc.

We may share your information with third parties in the following ways:

  • Service Providers: To third parties who perform services on our behalf, such as data processing, software management, and logistics, under strict confidentiality agreements.
  • Legal Obligations: When required by law or to protect the rights, property, or safety of our users, the public, or GoKidu, including to respond to lawful requests by public authorities.
  • With Consent: We may share information with other parties with your explicit consent.

b. Cookies

Cookies are small files that a site transfers to your computer's hard drive through your web browser (if you allow) that enable the site's systems to recognize your browser and capture and remember certain information. We use cookies to understand and save your preferences for future visits.

c. Disclosure to Third Parties

We do not sell, trade, or transfer your personally identifiable information to outside parties except to trusted third parties. Trusted third parties agreed with GoKidu to keep your information confidential and to only use it to assist us in operating our Site, App, and any other Services.

We may also release your information when we believe release is appropriate to comply with the law, enforce our site policies, or protect ours or others rights, property, or safety.

4. Third Party Links

Occasionally, at our discretion, we may include or offer third-party products or services on our Site or in the App that you may access via a link. These third-party sites have separate and independent privacy policies and it would be prudent for you to familiarize yourself with those separate privacy policies. We have no responsibility or liability for the content and activities of these linked sites.

5. Data Security

We implement a variety of security measures to maintain the safety of your stored personal information and when you enter, submit, or access your personal information.

6. How Long We Retain Your Data

We want the connections you make through our service to last forever, but we keep your personal data only as long as necessary for legitimate business reasons (as laid out in Section 4) and as permitted by applicable law.

If you decide to stop using our service, you can close your account and your profile will no longer be visible to other members. Note that we will close your account automatically if you are inactive for two years.

Following account closure, we delete your data as laid out below:

  1. To protect the safety and security of our members, we implement a safety retention window of three months following account closure or one year following an account ban. During this period, we keep your data to investigate unlawful or harmful conduct. The retention of data during this safety retention window is based on our legitimate interest as well as that of potential third-party victims.
  2. We maintain limited data to comply with legal data retention obligations: in particular, we keep transaction data for 10 years to comply with tax and accounting legal requirements, credit card information for the duration the user may challenge the transaction, and “traffic data” / logs for one year to comply with legal data retention obligations. We also keep records of consents members give us for five years to comply with and evidence of our compliance with applicable law.
  3. We maintain limited data on the basis of our legitimate interest: we keep customer care records and supporting data as well as imprecise location of download/purchase for five years in support of our safety efforts, to support our customer care decisions, enforce our rights and enable us to defend ourselves in the event of a claim, profile data for one year in anticipation of potential litigation, for the establishment, exercise or defense of legal claims, and data necessary to prevent members who were banned from opening a new account for as long as necessary to ensure the safety and vital interests of our members.
  4. Finally, we maintain data on the basis of our legitimate interest where there is an outstanding or potential issue, claim or dispute requiring us to keep data in particular if we receive a valid legal subpoena or request asking us to preserve data (in which case we would need to keep the data to comply with our legal obligations) or if data would otherwise be necessary as part of legal proceedings.

Where and as legally permitted, we may maintain and use data that, by itself, cannot identify or be attributed specifically to you for the purposes described in this Privacy Policy, including to improve our Services, and create new features, technologies and services.

7. Your Rights

Depending on where you live, you may not have the same rights or they may be named differently. If you have any questions on your rights and how to exercise them, please contact us here. At a minimum, all users/Members have the right to make any changes to their profile information at any time by logging into their profile and going to the 'Edit Profile' page.

  • Access and Update Your Information: As a user/Member of GoKidu, you have the right to access and update your personal information at any time. You can do this by logging into your account and making the necessary changes directly through the App interface.
  • Deletion of Your Information: If you have utilized our donation services (either donating or receiving eggs/sperm/embryo), there are specific stipulations regarding the deletion of your account information:
    • Retention of Information:
      • Transaction Settlement: Account details cannot be deleted until all associated transactions are fully settled. This ensures that all parties retain the necessary information to complete any pending processes.
      • Legal Records: To the furthest extent of applicable law, we retain records of all transactions to address any future legal inquiries or complications. These records are crucial for protecting the legal interests of all parties involved.
    • Deletion from App Interface: Once your account is eligible for deletion and you request to terminate your account, your profile and personal information will be removed from the App interface. This means it will no longer be visible to you or other users/Members. However, please note that this does not mean your information is deleted from our databases.
    • Data Retention in Database: Despite the removal of information from the App interface, we maintain records in our secure database to comply with legal and regulatory requirements. This information will be handled according to our data retention policy, which is designed to respect privacy while fulfilling legal obligations.

For your protection and the protection of all of our Members, we may ask you for information to verify your identity or authority to act on behalf of a Member before we can allow you to exercise any of the rights above.

Keep in mind, we may reject requests to exercise Rights, including if we are unable to authenticate you, if the request is unlawful or invalid, or if it may infringe on trade secrets or intellectual property or the privacy or other rights of someone else.

If you are a resident of Texas, Oregon, Montana, Virginia, Colorado, or Connecticut, USA, if we deny your Rights request, you may be able to appeal by contacting us, and explicitly referencing “Privacy Rights Appeal.” If you have concerns about the result of your appeal, you may contact the attorney general for your state.

In certain countries, including in the European Economic Area and the United Kingdom, you have a right to lodge a complaint with the appropriate data protection authority if you have concerns about how we process your personal data. You can find information about your data protection regulator in the European Economic Area here, and in the United Kingdom here. The data protection authority you can lodge a complaint with may be that of your habitual residence, where you work or where an alleged infringement took place.

8. Children's Privacy

Our Services are restricted to individuals who are 18 years of age or older. We do not permit individuals under the age of 18 on our platform or to use our Services. If you suspect that a member is under the age of 18, please use the reporting mechanism available on the Service.

9. Changes to This Policy

GoKidu reserves the right to update this Privacy Policy at any time. We will notify you of any changes by posting the new policy on our Site/App. Continued use of our Services after such changes will constitute your consent to those changes.
